1) Agreement to the Terms

These Terms of Use (“Terms”) are a legal agreement between Kynos Group LTD (“Kynos,” “we,” “us,” “our”) and you (“you,” “user,” or the entity you represent). They govern your access to and use of our websites, products, and services, including Kynos AI and Aboutly (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms and our Privacy Notice and Cookie Policy. If you do not agree, do not use the Services.

2) Who We Are

Kynos Group LTD owns and operates software and tools for creators, solopreneurs, and businesses, including link-in-bio pages, booking, analytics, CRM, payments, and AI assistant functionality.

3) Eligibility and Accounts

  • You must be at least 18 to use the Services.
  • You are responsible for the security of your account and credentials.
  • Keep your information accurate and up to date.
  • We may refuse, suspend, or terminate accounts that violate these Terms or applicable law.

4) Acceptable Use

You agree not to:

  • Break the law, violate rights, or interfere with the security or operation of the Services.
  • Scrape, harvest, or systematically collect data without written permission.
  • Upload malware, attempt to bypass security, or probe our systems.
  • Impersonate others or misrepresent your affiliation.
  • Use automated means to access or use the Services except standard search engine or browser usage.
  • Use the Services to compete with us, to build a database, or to replicate features.
  • Harass, threaten, or abuse anyone.
  • Use the Services to publish unlawful, defamatory, obscene, hateful, or misleading content.

We may monitor, log, and block traffic to protect the Services.

5) User Content and Feedback

User Content. If the Services let you upload or post content (“User Content”), you retain ownership of it. You grant Kynos a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process your User Content solely to provide and improve the Services.

Prohibited content includes anything unlawful, invasive of privacy, infringing, or harmful.

Feedback. If you share ideas or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or attribution.

6) Intellectual Property

The Services, including software, designs, text, graphics, logos, and trademarks, are owned by Kynos or our licensors. Except for your limited right to access and use the Services under these Terms, we reserve all rights.

You may not copy, modify, reverse engineer, or distribute the Services or any part of them unless the law allows it or we give written permission.

7) AI Features and Outputs

Some features use AI or machine learning (“AI Features”). By using them, you agree that:

  • You are responsible for the inputs you submit and the outputs you choose to rely on.
  • Outputs may be inaccurate or incomplete. Use human judgment for decisions with legal, financial, medical, or safety impact.
  • You will not input content that infringes rights or contains personal data you do not have a lawful basis to process.
  • We may use third-party AI providers (for example OpenAI, Google Cloud AI, Anthropic, etc.). Your use is also subject to their policies.
  • You will not use outputs to train models outside the Services unless permitted by law and by these Terms.

Nothing in this section limits your rights under the Privacy Notice.

8) Third-Party Services

The Services may integrate with third-party tools such as Stripe, analytics, or social login. Those services are governed by their own terms and privacy policies. We are not responsible for third-party services.

9) Privacy and Cookies

Your personal data is handled according to our Privacy Notice (last updated 10 August 2025) and our Cookie Policy.

10) Plans, Fees, and Payments

  • Some features require a paid plan or subscription. Prices, features, and limits are shown at checkout or in your account.
  • You authorize us and our payment processor (Stripe) to charge your payment method for fees, taxes, and renewal charges.
  • Auto-renewal: Subscriptions renew automatically for the same term unless you cancel before renewal.
  • Trials: If you do not cancel before a trial ends, billing starts on the first day after the trial.
  • Taxes: Prices may exclude VAT or sales tax which will be added where required.
  • Chargebacks: Contact us first to resolve billing issues. Unjustified chargebacks may result in suspension.

11) Consumer Cancellations and Cooling-off (UK/EU)

If you are a consumer in the UK or EU, you generally have a 14-day cooling-off period for digital services.

  • If you request immediate access and acknowledge that supply starts during the cooling-off period, you agree that the right to cancel may be lost once digital content is supplied.
  • This section does not limit your non-waivable statutory rights.

12) Service Changes and Availability

We may add, change, or remove features, and we may suspend service for maintenance or emergencies. We do not promise uninterrupted availability.

13) Term and Termination

These Terms apply while you use the Services. We may suspend or terminate your access if you violate these Terms or the law, or if we must do so to protect the Services or other users.

You may cancel at any time from your account or by contacting support. Sections that by nature should survive termination will survive, including IP, disclaimers, limits of liability, indemnity, and dispute terms.

14) Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not guarantee that outputs, content, or integrations will be error-free, secure, or uninterrupted.

15) Limitation of Liability

To the fullest extent allowed by law:

  • We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, data, or goodwill.
  • Our total liability for all claims in any 12-month period is limited to the greater of £100 or the fees you paid to us for the Services that gave rise to the claim during that 12-month period.

Some jurisdictions do not allow certain exclusions or limits. Those exclusions and limits apply only to the extent permitted by law and do not limit your statutory consumer rights.

16) Indemnity

You will indemnify and hold Kynos, its officers, directors, employees, and agents harmless from claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
a) your use of the Services; b) your breach of these Terms or law; c) your User Content; or d) your violation of others’ rights.

We may assume the defense of any matter at our expense. You will cooperate with us.

17) Data, Backups, and Security

We maintain safeguards to protect the Services and your data, as described in the Privacy Notice. You are responsible for keeping copies of your content and data. We are not responsible for loss or corruption of data except as required by law.

18) Electronic Communications and Signatures

You consent to receive notices and communications electronically and agree that electronic signatures and records have the same legal effect as paper versions, unless the law where you live requires otherwise.

19) Export, Sanctions, and Anti-Corruption

You must comply with all applicable export control, sanctions, and anti-corruption laws. You will not use the Services in or for the benefit of persons or locations under embargo or sanctions, or for any prohibited purpose.

20) Open Source and Third-Party Licenses

Some components may be provided under open-source licenses. To the extent of any conflict, those licenses control for their components.

21) Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, such as internet outages, cyberattacks, labor disputes, acts of government, or natural events.

22) Changes to These Terms

We may update these Terms. Material changes will take effect after a 30-day notice posted on the site or sent to your account email. If you continue to use the Services after the notice period, you accept the changes.

23) Governing Law and Venue

These Terms are governed by the laws of England and Wales.

  • Consumers in the UK/EEA/Switzerland: You may bring disputes in your local courts where required by law. Nothing here limits your non-waivable consumer rights.
  • Business users and non-consumer disputes: The courts of England and Wales have exclusive jurisdiction.

24) Dispute Resolution

Informal resolution

Before filing a claim, the parties will try to resolve disputes in good faith. Send a written notice of the dispute to support@kynosai.io. The parties will attempt to resolve it within 30 days.

Arbitration (non-consumer, optional)

For business-to-business disputes only, and if both parties agree in writing, disputes may be resolved by confidential arbitration in London, United Kingdom, before one arbitrator, in English, under the rules of a recognized institution (for example LCIA or ICC). Class or representative proceedings are not permitted where the law allows. This paragraph does not apply to consumers or to claims for injunctive relief about IP or misuse of the Services.

25) Miscellaneous

  • Entire agreement: These Terms, the Privacy Notice, and any order form are the entire agreement.
  • No waiver: Failure to enforce a provision is not a waiver.
  • Severability: If a provision is invalid, the rest remains in effect.
  • Assignment: We may assign these Terms. You may not assign them without our consent.
  • No agency: These Terms do not create a partnership, agency, or employment relationship.
  • Headings: For convenience only.
